TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the website www.fallenluxury.com (the "Site"), operated by Fallen Luxury Private Limited ("Fallen Luxury," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Fallen Luxury. If you do not agree to all terms, you are prohibited from using the Site.

2. The Fallen Luxury Authentication Guarantee

• The Standard of Authenticity. Every item listed on Fallen Luxury undergoes a rigorous, multi-point physical inspection conducted by our team of expert authenticators. We stand unequivocally behind the authenticity of every item sold on our platform.
• The Guarantee. In the event an item purchased on Fallen Luxury is conclusively proven to be inauthentic by an independent, certified expert mutually agreed upon by Fallen Luxury and the buyer, Fallen Luxury will provide a full refund of the purchase price, including original shipping costs.

3.The Fallen Luxury Marketplace

We provide a curated platform for the consignment and sale of pre-owned luxury goods. We act as an intermediary between sellers ("Consignors") and buyers.

4. Account Registration: Eligibility and Security

You must be at least 18 years old to use our services. You are responsible for maintaining the security of your account and for all activities that occur under it.

Terms for Consignors (Sellers)

• Consignment Agreement. By submitting an item for consignment, you grant Fallen Luxury the exclusive right to possess, authenticate, photograph, describe, and offer the item for sale on the Site.
• Authentication Fee. We provide complimentary authentication for all items submitted for consignment. However, we reserve the right to charge an authentication fee only if an item is deemed not authentic and rejected. This fee covers the cost of our expert inspection and validation process for inauthentic items.
• Pricing & Commission. The final listing price is determined collaboratively. You agree to pay Fallen Luxury a commission as a percentage of the final sale price, as agreed upon at the time of consignment.
• Payout. Upon successful sale and delivery of the item to the buyer, your net proceeds (sale price minus commission) will be processed and released to you via bank transfer within thirty (30) days, subject to the buyer's return window expiring without a valid return claim.

6. Terms for Buyers

Purchases All sales are final, except as explicitly provided in our Return Policy.

Return Policy Buyers have a period of three (3) calendar days from the confirmed date of delivery to initiate a return request. Returns are exclusively accepted for reasons of significant misrepresentation in the item's listing or under the terms of our Authentication Guarantee in Section 2.

Condition of Return The item must be returned in its original, unworn condition, with all original packaging and tags. Crucially, the official "Fallen Luxury" return tag must be securely attached. Returns will not be accepted if this tag has been removed or damaged. Returns for buyer's remorse or size preferences are not accepted.

Risk and Title Title and risk of loss for any item you purchase pass to you upon our delivery of the item to the common carrier.

7. Intellectual Property

The Site, its original content, features, functionality, logos, and product designs are the exclusive property of Fallen Luxury Private Limited and are protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Fallen Luxury Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total cumulative liability to you for any claim shall not exceed the total amount you paid for the item giving rise to the claim.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal suit or action arising out of or relating to these Terms shall be instituted exclusively in the courts of Mumbai, Maharashtra, India.
